Service Performance:
Big Reds Dumpster Rental will provide waste hauling and disposal services using our roll-off containers, trucks, and trailers. Service will be provided on a same or next-day available basis.
Waste Material:
State laws and the EPA govern the disposal of hazardous waste. The purpose of Big Reds Dumpster Rental services is solely to remove and dispose of customer's non-hazardous and non-toxic solid waste. Customers agree not to deposit any waste that is liquid, radio-active corrosive, highly flammable, explosive bio-hazard infectious, toxic, hazardous waste, or prohibited waste into Big Reds Dumpster Containers. Prohibited Waste includes, but is not limited to tires, paint, herbicides, pesticides, batteries, electronics of any kind, appliances including refrigeration, air conditioning units, and large tree stumps are NOT allowed.
Inspection; Rejection of Prohibited Waste:
Title to and liability for Prohibited Waste shall always remain with the customer. Big Reds Dumpster Rental shall have the right to inspect, analyze, or test any waste delivered by the customer. If a customer's waste is reasonably believed to be prohibited waste, Big Reds can reject the prohibited waste at the customer's expense. The customer shall pay or reimburse Big Reds Dumpster Rental for all costs, damages, and or fines incurred, because of or relating to the customer's deposit of prohibited waste in Big Reds Dumpster containers or other failures to comply or conform to these terms and conditions, including cost inspection, testing, and analysis.
Volume and Weight:
State law governs gross vehicle weight. The customer agrees to pay for overweight charges. Disposal charges are also directly related to weight. Customer's use of Big Reds Dumpster Rental service includes the cost of hauling and disposal of up to the tonnage allotted per container. Additional charges of $80.00 per ton will apply to debris in excess of tons. In no event will the customer load debris weighing more than 6 tons, as that would exceed gross weight limits of Big Reds Dumpster Rental equipment. Containers may not be filled above the top edge. Big Reds Dumpster Rental reserves the right to refuse to haul containers that exceed the legal weight limit. Big Reds Dumpster Rental reserves the right to terminate service if the customer does not abide by the regulations.
Trip Charge and Relocation Charges:
The customer agrees to pay for truck time if a container is overloaded, overweight, or if the container itself or a location designated by the customer for service by our container is blocked, so that we cannot complete the service. The designation of fees associated with any of these failed service attempts is a trip charge and this charge may be assessed at rates up to $150 per event. Relocation of a container from one job to another may also be assessed at rates up to $100 per event, or higher, depending on the distance and time involved.
Refusal to Pay:
In the unlikely event a customer's attempt to pay with a credit card is repeatedly declined, and the customer fails to remedy the issue in a timely manner, Big Reds Dumpster Rental has the right to reclaim their container and dump any-and-all contents at the location where the container was placed. By ordering and accepting the container, the customer accepts the consequences of non-payment.
Equipment Rental Period:
The daily container rental period starts the day the container is delivered. The delivery and pick up equipment rental are for those specific acts of delivering and picking up the container. The customer agrees to notify Big Reds Dumpster Rental of a container rental extension, before the end of the original rental period. If the customer neglects to abide by the terms and conditions set forth by Big Reds Dumpster Rental, the customer agrees payment will be due and the container will be returned to Big Reds Dumpster Rental. If no extension is requested in advance, Big Reds Dumpster Rental can pick up the container any time after the rental period expired without further notification.
Equipment:
All containers and delivery equipment used to provide the service to the customer are and shall remain the property of Big Reds Dumpster Rental. The customer assumes responsibility for any damage to containers beyond normal wear an tear. The customer agrees to provide Big Reds Dumpster Rental with access to its containers at all reasonable times to provide service over surfaces that could sustain the weight and operation of Big Reds Dumpster Rental's trucks, trailers, and containers. The customer acknowledges that Big Reds Dumpster Rental containers or trucks serving containers in the agreed-upon location areas The customer agrees to pay any violations as a result of the container's location. The customer agrees to file and obtain city, state, and county permits when necessary and will not hold Big Reds Dumpster Rental liable for any violations from local, state, or federal organizations.
Payment:
The customer agrees to pay by check, cash, or allowing the credit card on file to be charged upon the receipt or delivery of the dumpster plus excess weight charges or other charges at the time determination of an additional amount has been made. The customers agrees that any account that is past due 30 days or more is deemed delinquent, and Big Reds Dumpster Rental shall have the right to terminate service under this agreement and file any mechanics lien against the property services. The customer also agrees that a late fee of 1.5% per month shall apply to the customer's account if it becomes delinquent, should big Reds Dumpster Rental be forced to initiate collection, attorney fees, and court costs.
